Tree Service Terms & Conditions
By accepting an estimate, proposal, or work order from CNY Tree Service (“Company”), the customer/property owner (“Customer”) agrees to the following Terms & Conditions.
1. Authorization to Perform Work
Customer authorizes the Company and its employees, subcontractors, vehicles, cranes, loaders, chippers, stump grinders, and other equipment to enter the property and perform the work described in the accepted estimate.
Customer represents that they are the property owner or have authority from the property owner to authorize the work.
2. Scope of Work
Only work specifically described in the accepted estimate is included in the quoted price.
Any additional work requested by the Customer, including additional tree removal, trimming, cleanup, hauling, stump grinding, or work not reasonably anticipated at the time of the estimate, may result in additional charges.
Changes to the scope of work should be approved by the Customer before additional work is performed whenever reasonably possible.
3. Property Lines & Tree Ownership
Customer is responsible for identifying property boundaries and confirming ownership of all trees included in the work.
The Company is not responsible for disputes between neighbors or property owners concerning tree ownership, property boundaries, or authorization to perform the requested work.
Customer agrees to indemnify and hold the Company harmless from claims arising from inaccurate information regarding property ownership, property lines, or Customer’s authority to authorize the work.
4. Access to the Property
Customer agrees to provide reasonable and safe access to the work area. Tree work may require the use of heavy equipment, including cranes, bucket trucks, loaders, chippers, stump grinders, and other machinery.
Customer authorizes the Company to reasonably access and utilize lawns, driveways, parking areas, and other portions of the property necessary to complete the contracted work, including for equipment setup, staging, and maneuvering.
Crane Operations & Heavy Equipment
Crane Placement
The Company and/or crane operator will determine final crane placement and setup location based on safety, ground conditions, access, and operational requirements.
Outriggers & Stabilization
Cranes and heavy equipment may require outriggers, stabilizers, cribbing, mats, or blocking. These may be placed on lawns, driveways, or other surfaces as needed for safe operation.
Surface Impact
Customer understands that heavy equipment may cause impressions, ruts, cracking, settling, or other surface disturbance to lawns, driveways, sidewalks, curbs, landscaping, septic areas, or other surfaces, particularly in soft, wet, frozen, or previously compromised ground conditions.
Driveways & Hard Surfaces
The Company is not responsible for damage to asphalt, concrete, pavers, curbing, or similar surfaces resulting from the weight of heavy equipment when such equipment is operated in a reasonable and necessary manner for the completion of the work.
Underground Conditions
Customer is responsible for disclosing all known underground utilities and structures, including septic systems, leach fields, drainage systems, irrigation, invisible fencing, water lines, propane lines, and any other subsurface improvements. The Company is not responsible for damage resulting from unknown, unmarked, or undisclosed subsurface conditions.
Safe Operation
The Company reserves the right to modify, delay, or refuse crane setup or heavy equipment use if conditions are determined to be unsafe.
The Company will use reasonable care to minimize disturbance; however, Customer understands that some level of surface impact is inherent in professional tree work involving heavy equipment.
5. Underground Utilities & Private Systems
Customer is responsible for informing the Company of any private or unmarked underground systems, including but not limited to:
- Invisible dog fences
- Irrigation and sprinkler systems
- Landscape lighting or wiring
- Private electrical lines
- Septic tanks and leach fields
- Drainage systems
- Wells and water lines
- Propane or fuel lines
- Privately installed communication lines
The Company is not responsible for damage to private or improperly marked underground utilities or systems that were not disclosed before work began.
6. Stump Grinding
Unless specifically stated in the estimate, stump grinding is not included with tree removal.
When stump grinding is included, grinding depth and area will be limited to what is stated in the estimate and what can reasonably and safely be accessed by the equipment.
Stump grinding does not include complete removal of the underground root system.
Unless specifically included in the estimate, removal of stump grindings, backfilling the hole, adding topsoil, seeding, or landscaping is not included.
7. Lawn & Landscape Conditions
The Company will make reasonable efforts to protect lawns and landscaping. Customer understands, however, that tree work inherently involves falling limbs, logs, wood, debris, foot traffic, and heavy equipment.
Minor lawn impressions, divots, sawdust, twigs, and normal disturbance associated with professional tree work are not considered property damage.
8. Cleanup
Cleanup will be performed according to the accepted estimate.
Unless otherwise specified, standard cleanup includes removal of debris generated by the contracted tree work and reasonable raking/blowing of the immediate work area.
Firewood-length logs, wood chips, stump grindings, or other material will remain on the property if the estimate specifies that those materials are to be left for the Customer.
9. Hidden or Hazardous Conditions
Tree work may reveal conditions that could not reasonably be identified during the initial estimate, including internal decay, hollow trunks, concealed metal, concrete, cables, nails, fencing, bee/wasp nests, unstable root systems, underground obstructions, or other hazardous conditions.
If an unforeseen condition materially changes the difficulty, equipment requirements, or safety of the job, the Company may stop work and discuss revised pricing or procedures with the Customer before continuing.
10. Weather & Scheduling
All scheduling is subject to weather, ground conditions, equipment availability, emergencies, utility conflicts, and other circumstances affecting safe tree operations.
The Company reserves the right to postpone or reschedule work when conditions are unsafe or could cause unreasonable property damage.
Estimated work dates are not guaranteed unless specifically stated in writing.
11. Emergency & Hazardous Tree Work
Customer understands that hazardous and emergency tree removal involves inherent risks.
When a tree has failed, partially failed, become uprooted, split, storm damaged, structurally compromised, or is resting on a structure or another tree, conditions may change unexpectedly during removal.
The Company will use professional judgment and reasonable safety practices when completing such work.
12. Utilities & Service Lines
If work is located near electrical, telephone, cable, internet, or other utility lines, work may need to be delayed until the appropriate utility company provides clearance, protection, disconnection, or other assistance.
The Company is not responsible for delays caused by utility providers.
13. Permits & Approvals
Unless specifically included in the estimate, Customer is responsible for determining whether HOA approval, municipal approval, permits, or other authorization is required for the requested work.
Customer is responsible for obtaining required approvals unless the estimate specifically states that the Company will obtain them.
14. Customer Responsibilities Before Work Begins
Before the scheduled work date, Customer should remove vehicles, outdoor furniture, decorations, toys, grills, pet waste, and other movable items from the work and access areas.
Children and pets must remain safely away from the work area while operations are underway.
15. Payment
Payment terms will be stated on the estimate or invoice.
Unless otherwise agreed in writing, payment is due upon completion of the contracted work.
Past-due balances may be subject to reasonable late fees, collection costs, and other charges permitted by applicable law and stated on the invoice or agreement.
Customer is responsible for any returned-payment or chargeback costs permitted by law.
16. Deposits & Cancellations
If a deposit is required, the amount and applicable cancellation/refund terms will be stated in the estimate.
Customer should notify the Company as soon as possible if work needs to be canceled or rescheduled.
The Company reserves the right to charge reasonable costs associated with a late cancellation when crews, specialty equipment, cranes, subcontractors, traffic control, permits, or other resources have already been committed specifically to the Customer’s project, to the extent permitted by law.
17. Completion of Work
Work will be considered substantially complete when the services described in the accepted estimate have been performed.
Minor cleanup concerns or punch-list items do not relieve the Customer of responsibility for payment for completed work.
Customer should notify the Company promptly of any concerns regarding the completed work so the Company has a reasonable opportunity to inspect and address them.
18. Tree Health & Future Condition
Pruning, cabling, removal of hazardous limbs, or other tree services cannot guarantee the future health, stability, or survival of a tree.
Trees are living organisms affected by weather, disease, insects, soil conditions, previous damage, root systems, and other factors outside the Company’s control.
The Company does not guarantee that a tree will not later fail, decline, become diseased, or die.
19. Photographs & Documentation
The Company may photograph or video the work area before, during, and after the project for documentation, safety, training, and business purposes.
Photos or videos that clearly identify the Customer or disclose private personal information will not be intentionally used for advertising without appropriate permission.
20. Limitation of Responsibility
The Company will exercise reasonable care in performing the contracted work.
The Company is not responsible for damage or loss caused by concealed conditions, undisclosed private utilities, inaccurate property information, pre-existing defects, acts of nature, or conditions outside the Company’s reasonable control.
Nothing in these Terms & Conditions is intended to waive liability that cannot legally be waived under applicable law.
21. Acceptance
Acceptance of the Company’s estimate electronically, by signature, or by other written authorization constitutes acceptance of both the scope of work described in the estimate and these Terms & Conditions.
By accepting the estimate, Customer acknowledges that they have had an opportunity to review these Terms & Conditions and agree to be bound by them.
